The terms “we”, “us” and “our” refer to Mimo Beauty. Mimo Beauty operates this online store and website, including the information, content, features, tools, products and services made available through it (the “Services”).

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service, together with our Privacy Policy, Return and Refund Policy and Shipping Policy, set out the terms that apply when you visit, use or purchase from our website.

Please read these Terms carefully before using our Services or placing an order.

Nothing in these Terms affects your statutory rights under applicable UK consumer law.

1. ELIGIBILITY AND ACCOUNT INFORMATION

By using our Services or placing an order, you confirm that you are legally capable of entering into a binding contract.

When placing an order or creating an account, you agree to provide accurate, current and complete information, including your contact, billing, payment and delivery details.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account.

2. OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, colours, dimensions and other information shown on our website are accurate.

However, colours and appearance may vary slightly depending on your device, screen settings, lighting and photography.

As our press-on nails are handmade or individually finished, minor variations may occur between products. These variations do not necessarily constitute a defect.

Product availability is subject to stock. We may discontinue or limit the availability of products at any time.

Nothing in this section limits your statutory rights where goods are faulty, not as described or otherwise do not conform to the contract.

3. ORDERS

When you place an order, you are offering to purchase the products in your basket.

After placing an order, you will receive an order confirmation by email. We reserve the right to decline or cancel an order where reasonably necessary, including where:

a product is unavailable;
payment cannot be authorised;
information provided is incomplete or incorrect;
we identify an obvious pricing or listing error; or
we reasonably suspect fraud or misuse of our Services.

If we cancel an order after payment has been taken, we will refund the amount paid using the original payment method.

4. PRICES AND PAYMENT

All prices are displayed in GBP (£) unless otherwise stated.

The price payable is the price shown at checkout when your order is submitted, together with any applicable delivery charges.

Mimo Beauty is not currently VAT registered. Where this changes, applicable taxes will be handled in accordance with UK law.

We reserve the right to change prices, discounts or promotions at any time, but changes will not affect orders that have already been accepted.

You agree to provide valid and authorised payment information when placing an order.

5. SHIPPING AND DELIVERY

We currently deliver within the United Kingdom only.

Orders are normally processed within 1–2 working days.

Standard UK delivery usually takes 3–5 working days after dispatch.

Delivery dates are estimates and may be affected by circumstances outside our reasonable control.

Our current delivery charges, free-delivery threshold and further delivery information are set out in our Shipping Policy.

We remain responsible for goods in accordance with applicable UK consumer law during delivery.

6. RETURNS AND REFUNDS

Your rights to cancel an online order, return eligible products and obtain refunds are explained in our Return and Refund Policy.

Nothing in these Terms limits or excludes any rights you have under applicable consumer law, including your rights in relation to faulty, damaged, misdescribed or non-conforming goods.

7. INTELLECTUAL PROPERTY

Unless otherwise stated, the content available through our website, including our branding, logos, text, photographs, graphics, product imagery, designs and website content, is owned by or licensed to Mimo Beauty and is protected by applicable intellectual property laws.

“Mimo Beauty” and associated branding may not be used in a way that suggests endorsement, affiliation or ownership without our permission.

We are not responsible for the content, availability or practices of third-party websites that we do not control.

Mimo Beauty is powered by Shopify, which provides the ecommerce platform that allows us to operate our online store.

Any purchase you make through our store is made directly with Mimo Beauty, not Shopify.

Shopify may process certain information in connection with your use of our website and purchases in accordance with its own terms and privacy practices.

10. PRIVACY

Our collection and use of personal information is described in our Privacy Policy.

Because our store is hosted by Shopify, certain personal information may also be processed by Shopify and other service providers that help us operate our store, fulfil orders and provide our Services.

If you voluntarily submit a product review, photograph, comment or other feedback to us, you confirm that you have the right to provide that content.

We supply products for personal and domestic use. Subject to applicable law, we are not responsible for business losses arising from use of products for commercial purposes.

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

If we do not immediately enforce a right or provision under these Terms, this does not mean that we have waived that right.

The latest version will be available on this page.

Changes will not retrospectively remove rights that have already arisen under an existing customer contract.

These Terms and any contract between you and Mimo Beauty are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from any mandatory protections available to you under the laws of the part of the UK in which you live.

Nothing in these Terms affects any mandatory consumer rights regarding where legal proceedings may be brought.
